Please read these Terms of Service carefully. By accessing or using Mine Medical Control, you agree to be bound by these terms. If you do not agree, you must not use the platform.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Subscriber", "you" or "your") and Mine Medical Control ("we", "us", "our"), the operator of Mine Medical Control, regarding your access to and use of the Mine Medical Control software platform available at mine-medical-control.web.app and associated services (collectively, the "Platform").

These Terms apply to all users of the Platform, including organisation administrators, clinical staff and any other authorised personnel granted access by a subscribing organisation.

2. Eligibility

To use Mine Medical Control, you must:

  • Be at least 18 years of age
  • Be accessing the Platform on behalf of a legitimate mining or resource sector operation in Australia, or as an authorised healthcare provider servicing such operations
  • Have the authority to bind your organisation to these Terms (if subscribing on behalf of an organisation)
  • Use the Platform only in your professional capacity as part of a mine site medical operation

The Platform is intended for use by qualified medical professionals including paramedics, nurses, doctors, Mine Emergency Services Officers (MESOs) and authorised medical administrators. It is not a consumer health product.

3. Accounts & Access

3.1 Organisation Accounts

Each subscribing organisation is granted one or more administrator accounts and may create additional user accounts within their subscription limits. The organisation administrator is responsible for managing user access and ensuring all users comply with these Terms.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Ensuring that only authorised personnel are granted access to your organisation's account
  • All activity that occurs under your account or your organisation's account
  • Notifying us immediately at sales@minemc.com.au if you suspect unauthorised access

We will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials.

3.3 Role-Based Access

The Platform provides role-based access controls. Organisation administrators are responsible for assigning appropriate roles to users and ensuring role assignments reflect each user's clinical qualifications and employment status. Access should be revoked promptly when a staff member departs.

4. Subscriptions & Billing

4.1 Plans & Pricing

Mine Medical Control is offered on a monthly subscription basis. Current pricing plans are published at minemc.com.au and are subject to change with 30 days' notice.

4.2 Free Plan

We may offer a free plan at our sole discretion for eligible organisations (e.g., pilot programmes, demonstration purposes). Free plan access may be modified or revoked at any time with 7 days' notice.

4.3 Payment

Subscription fees are billed monthly in advance in Australian Dollars (AUD). Payments are processed via Stripe. By providing payment details, you authorise us to charge your nominated payment method on a recurring monthly basis. All prices are exclusive of GST unless otherwise stated.

4.4 Failed Payments

If a payment fails, access to paid features may be suspended until the outstanding amount is settled. We will attempt to notify you by email before suspending access.

4.5 Cancellation & Refunds

You may cancel your subscription at any time through the Platform's billing portal. Cancellation takes effect at the end of the current billing period — you will retain access until that date. We do not provide refunds for partial months, except where required by Australian Consumer Law.

4.6 Price Changes

We will provide at least 30 days' written notice before increasing subscription prices. Continued use of the Platform after the notice period constitutes acceptance of the new pricing.

5. Acceptable Use

You agree to use the Platform only for lawful purposes in connection with legitimate mine site medical operations. You must not:

  • Enter false, misleading or fabricated clinical information into patient records
  • Use the Platform to record drug transactions that are not genuine, authorised clinical events
  • Attempt to circumvent, hack, reverse-engineer or otherwise interfere with the Platform's security, authentication or functionality
  • Access accounts, data or systems belonging to another organisation
  • Share login credentials or allow unauthorised individuals to access the Platform
  • Use the Platform to store or transmit content that is unlawful, defamatory, fraudulent or in breach of a third party's rights
  • Scrape, harvest or bulk-export data from the Platform without authorisation
  • Use the Platform in any way that could damage, disable or impair its availability to other users
Falsification of controlled drug records (S8 registers) is a serious criminal offence under the Medicines and Poisons Act 2014 (WA) and other applicable legislation. We are required to report suspected fraudulent use to relevant authorities.

6. Health Data Obligations

6.1 Your Obligations as Data Controller

As the subscribing organisation, you are the data controller for all patient and clinical information entered into the Platform. You are responsible for:

  • Ensuring that the collection and processing of health information through the Platform complies with the Privacy Act 1988 (Cth), applicable state health privacy legislation, and professional standards
  • Obtaining any necessary consents from patients for the electronic recording of their health information
  • Ensuring that only appropriately qualified and authorised clinical staff access and enter patient data
  • Maintaining appropriate clinical governance over the information recorded in the Platform
  • Complying with your obligations under the Medicines and Poisons Act 2014 (WA) and Medicines and Poisons Regulations 2016 (WA) for all controlled drug records

6.2 Our Role as Data Processor

We process health information solely on your instructions as part of providing the Platform services. We do not access, use or disclose patient health information other than as necessary to operate, maintain and support the Platform, except as required by law.

6.3 Not a Substitute for Clinical Judgement

Mine Medical Control is a documentation and records management tool. It is not a clinical decision support system and does not provide medical advice. All clinical decisions must be made by appropriately qualified healthcare professionals. Nothing in the Platform constitutes medical advice or guidance.

7. Intellectual Property

7.1 Our Platform

The Platform, including its software, design, user interface, features, algorithms, branding and all associated intellectual property, is owned by Mine Medical Control and is protected by Australian and international copyright, trademark and other intellectual property laws. Nothing in these Terms grants you any right to our intellectual property other than the limited licence to use the Platform in accordance with your subscription.

7.2 Your Data

You retain full ownership of all clinical data, patient records and other content entered into the Platform by your organisation ("Your Data"). You grant us a limited, non-exclusive licence to store, process and transmit Your Data solely as necessary to provide the Platform services.

7.3 Feedback

If you provide feedback, suggestions or ideas about the Platform, you grant us a perpetual, royalty-free licence to use that feedback to improve our services without any obligation to you.

8. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the use of the Platform. This obligation does not apply to information that:

  • Is or becomes publicly available through no fault of the receiving party
  • Was already known to the receiving party before disclosure
  • Is independently developed by the receiving party without reference to the confidential information
  • Must be disclosed by law or court order (with prompt notice to the other party where lawful)

9. Service Availability

We aim to maintain high availability of the Platform but do not guarantee uninterrupted service. The Platform may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where possible)
  • Unplanned outages of underlying infrastructure (Google Firebase / Google Cloud Platform)
  • Events outside our reasonable control (force majeure)

Mine Medical Control is intended to complement — not replace — physical clinical documentation systems. Subscribers are advised to maintain paper-based backup procedures for S8 drug registers and critical patient records in the event of platform unavailability, as required under WA pharmaceutical regulations.

10. Limitation of Liability

To the maximum extent permitted by Australian law, the following limitations apply to our liability to you.

Our total aggregate liability for any claims arising out of or in connection with these Terms or use of the Platform shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

We are not liable for:

  • Indirect, incidental, special, consequential or punitive damages
  • Loss of profit, revenue, data, business opportunity or goodwill
  • Clinical outcomes, patient outcomes or adverse events resulting from information entered into or generated by the Platform
  • Regulatory penalties or enforcement actions arising from your use of the Platform
  • Loss resulting from your failure to maintain backup records
  • Unavailability of the Platform beyond our reasonable control

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under Australian Consumer Law.

11. Indemnity

You agree to indemnify, defend and hold harmless Mine Medical Control and its officers, employees and agents from and against any claims, damages, losses, costs (including legal fees) arising from:

  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Your use of the Platform in a manner not authorised by these Terms
  • Any third-party claim arising from Your Data or your clinical operations
  • Your failure to comply with your obligations as data controller under privacy legislation

12. Termination

12.1 By You

You may terminate your subscription at any time through the billing portal. Termination takes effect at the end of the current billing period.

12.2 By Us

We may suspend or terminate your access to the Platform, with or without notice, if:

  • You materially breach these Terms and fail to remedy the breach within 14 days of notice
  • We reasonably suspect fraudulent use, misuse or illegal activity
  • Payment for your subscription is more than 14 days overdue
  • We are required to do so by law or regulatory authority
  • We discontinue the Platform (with 60 days' notice in this case)

12.3 Effect of Termination

Upon termination, your access to the Platform will cease. We will retain Your Data for the period set out in our Privacy Policy to allow for data export requests. You may request an export of Your Data within 30 days of termination by contacting sales@minemc.com.au. After the retention period, data will be permanently deleted.

13. Governing Law

These Terms are governed by the laws of Western Australia, Australia. The parties submit to the exclusive jurisdiction of the courts of Western Australia for any disputes arising out of these Terms or use of the Platform.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010 Schedule 2).

14. Changes to Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice by email to the registered organisation administrator. For minor changes (such as clarifications), we will update the "Last updated" date and post a notice on the Platform.

Continued use of the Platform after the effective date of updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must cancel your subscription before they take effect.
